Government Type and Texas Statutes

City of Troup, Texas

Government Structure

The City of Troup operates as a Type A General Law municipality under the Mayor-Council (or aldermanic) form of government.

Unlike “home-rule” cities that adopt their own locally written charters, a general law city derives its legal authority, organizational structure, and operational powers directly from the state legislature through the Texas Local Government Code.

Under the Mayor-Council framework, executive and legislative responsibilities are shared between an elected Mayor and the City Council to ensure transparent, accountable local governance.

Governing Statutory Framework

Troup’s municipal powers, officer responsibilities, and legislative procedures are governed by several key chapters within the Texas Local Government Code:

1. Structure & Authority of Officers

  • Chapter 22 (Aldermanic Form of Government in Type A General-Law Municipality): Establishes the foundational framework for city officials.
    • § 22.037 (Mayor as Presiding Officer; President Pro Tempore): The Mayor presides over City Council meetings and votes only in the event of a tie.
    • § 22.042 (Powers and Duties of Mayor): Designates the Mayor as the chief executive officer of the city, responsible for ensuring municipal laws and ordinances are enforced.
    • § 22.038 (Meetings): Outlines rules governing regular and special meetings of the governing body, quorum requirements, and council member attendance expectations.
    • §§ 22.071–22.077 (Other Municipal Officers): Governs the appointment, duties, and removal of non-elected city officers.
  • § 341.001 (Police Force of Type A General-Law Municipality): Separately authorizes the City to establish and regulate a municipal police force.

2. Ordinance & Rulemaking Powers

  • Chapter 51 (General Powers of Municipalities): Grants Type A general law cities broad authority to adopt ordinances, resolutions, or rules necessary to protect the health, safety, peace, and welfare of the community.
  • Chapter 52 (Adoption of Municipal Ordinances): Establishes standard procedures for drafting, passing, and publishing local ordinances. Under § 52.003, the Mayor reviews passed ordinances and may return one to the Council with objections for reconsideration.

3. Financial Governance & Budgeting

  • Chapter 101 (General Financial Provisions Affecting Municipalities) & Chapter 102 (Municipal Budget): Governs financial administration and mandates preparation of an annual municipal budget. Under § 102.001, the Mayor serves as the city’s budget officer, working alongside administrative staff and Council to prepare and present the proposed budget for public review and adoption.
